New Brunswick’s highest court has ruled a doctor provided unsafe medical care when he failed to tell a patient he was HIV-positive.<\/p>\n
Five men who all contracted HIV from blood transfusions said they were not told until they went to see their doctor that they had the virus.<\/p>\n
They brought the suit after the province’s Health Department allowed the doctor’s licence to expire and removed his name from a list of approved doctors.<\/p>\n
The decision by the court judges ends months of fighting between the men and the province.<\/p>\n
The court was told that three of the men were ordered to donate blood before testing positive and two were infected through a blood transfusion.<\/p>\n
However, the doctors involved in their treatment didn’t tell them of their diagnosis until after the transfusions.<\/p>\n
Albert Kormann, who was wrongly diagnosed with HIV but is now cleared of the virus, said he’s pleased the court decision.<\/p>\n
“It’s a big relief,” he said. “I think it’s finally started to become a reality.”<\/p>\n
The patients, who wanted their names suppressed, said they decided to sue in 2008 after the Health Department found a doctor who was also HIV positive.<\/p>\n
Andrew Steben said when he was in need of a blood transfusion to help prevent the spread of Hepatitis C, he went to see a doctor recommended by his girlfriend.<\/p>\n
“I had no idea he was HIV positive at the time,” Steben said. “I didn’t know what I was getting myself into.”<\/p>\n
Shawn Cassar said he became infected through a blood transfusion and was made aware of the issue following his surgery. He said he felt betrayed.<\/p>\n
“It was a shock to me, actually,” he said.<\/p>\n
“I felt betrayed. I felt a sense of injustice in this.”<\/p>\n
But the attorney who represented the doctor said the judge agreed that the doctor’s practice could not be justified.<\/p>\n
“We wish that the government, in good faith, had acted in such a way that they wouldn’t have breached the basic core values that underpin the notion of the Hippocratic oath,” said lawyer Christin Mack.<\/p>\n
